Terms of Sale

1. Who we are and who sells to you

PigmentPaw (pigmentpaw.com) is operated by Nicolò Luppi, an individual based in Italy, support@pigmentpaw.com ("we", "us").

We currently sell through our Etsy shop PigmentPawArt (etsy.com/shop/PigmentPawArt). Purchases there are governed by Etsy’s terms and policies; these Terms apply to them in addition, where compatible (product, photos, previews, revisions, licence).
Purchases directly on pigmentpaw.com are not currently offered. If we start offering them, we will publish the applicable terms first.

2. The product

A digital portrait of your pet created from your photos. Nothing physical is shipped. Depending on the item you receive high-resolution image files (JPG; PNG only where stated, e.g. ornament designs; and where stated phone wallpaper, Instagram crop or PDF formats). Bundles are delivered as a single zip file. Colours may vary slightly between screens and printers.

3. AI disclosure

Portraits are created with artificial-intelligence image tools, run through fal.ai, using our own prompts and art direction: previews with Google’s Nano Banana 2.1; final files with OpenAI’s GPT Image 2.5 plus the SeedVR2 upscaler for the Royal / Renaissance and Memorial (flowers & rainbow) styles (Google’s Nano Banana Pro if that pipeline is unavailable), Google’s Nano Banana 2.1 for the 3D cartoon styles and Google’s Nano Banana Pro for all other styles. We check the likeness of every portrait ourselves before delivery. See our Privacy Policy for how your photos are processed. No human painter paints them by hand. Because of how AI works, a similar style may be produced for other customers, and generated images may contain invisible digital provenance markers.

4. Photos and free previews

Each portrait uses 1 to 5 reference photos of your pet (for a two-pet portrait, up to 5 photos per pet). After you upload your photos for your Etsy order you see low-resolution, watermarked previews and choose your favourite. Previews may not be used, downloaded for use or edited to remove the watermark.

5. Ordering and delivery

Your Etsy order confirmation and our “How it works” PDF contain our upload page, pigmentpaw.com/etsy-upload. Enter your Etsy order number and the buyer name exactly as shown on your Etsy order (email optional); we check the order live with Etsy (paid, not refunded or cancelled, item bought). After 5 failed attempts within an hour, verification is paused for 1 hour. If your order contains several portraits, you get one upload for each. You then upload your photos (1 to 5, up to 5 per pet for two pets; at least 1000 px on the short side recommended).
Uploads are possible for 14 days after purchase and up to 5 uploads per portrait (first upload plus revisions), whichever comes first, and are blocked on a full refund or cancellation. If you have not uploaded within 24 hours of your order, we send you a reminder in Etsy Messages. Alternatively you can send photos or a Google Photos/iCloud album link in Etsy Messages and we upload them for you.
Your free preview is ready within 24 hours of receiving usable photos; final files arrive within 24 hours of your choosing the style, as download links in your Etsy order update (Etsy also emails that update to you). Etsy’s system cannot attach a different file to each order: the listing’s digital file is our “How it works” PDF, the same for everyone. We do not currently send emails ourselves.
Download links and final files expire 30 days after delivery and are then deleted; the Etsy order update states the exact expiry date and time in UTC. Please download and keep a copy; after deletion we cannot restore the files.
If you do not see the Etsy order update, check your Etsy Messages and spam folder and contact us through Etsy Messages.

6. Likeness, revisions and our satisfaction promise

2 free revision rounds are included, requested within 14 days of delivery. A round is one request listing all the changes you want, followed by our new version.
Included as revisions: likeness corrections (markings, coat and eye colour, ear shape, face/muzzle, fur) and small changes within the same style (background colour, crop, name/date text).
Not counted as revisions: choosing another preview we already sent; fixing our own mistakes (e.g. misspelt name, anatomy errors, broken files) – we always fix these for free.
After your order has shipped, revised files are delivered as a download link in an Etsy message from us. If the upload period (14 days after purchase or 5 uploads) is over, send revision notes or any new photos in Etsy Messages; we upload them on our side.
Not included: a different style after final delivery, adding or changing the animal, or new photos changing the subject after approval – these are a new order.
If, after the revision rounds, the portrait still doesn’t look like your pet, we redo it or refund you – your choice.

7. Refunds

Full refund if: the likeness is still not right after the revision rounds and you prefer a refund to a redo; we are unable to produce an acceptable portrait; you cancel before we have started work (e.g. no photos sent yet); you were charged twice for the same order.
Partial refunds may be offered where only part of an order is affected (e.g. one item of a bundle) or as stated in a listing.
Apart from these cases and your statutory rights, we do not refund a simple change of mind after you have chosen the preview and received the final files.
Refunds are issued through Etsy to your original payment method. After a full refund or a cancellation, download links are revoked, final files are deleted and the licence in section 9 ends; our system does this as soon as it detects the refund or cancellation on Etsy. A partial refund does not end your licence or delete your files; we review it manually.

8. Right of withdrawal (EU/UK consumers)

Consumers in the EU and the UK normally have a 14-day right of withdrawal for distance purchases. Under EU and UK consumer law this right does not apply to goods or digital content made to the consumer’s specifications or clearly personalised (Art. 16(c) Directive 2011/83/EU; Art. 59(1)(c) Italian Consumer Code), and for other digital content it ends once supply has begun with your prior express consent and acknowledgement. Each portrait is made to order from your photos and choices. You can still cancel free of charge before we start work (section 7). Your statutory rights for digital content that is faulty or not as described (legal guarantee of conformity) and our satisfaction promise in section 6 always apply. For orders placed on Etsy, Etsy’s checkout and policies also apply.

9. Licence to use your portrait

On full payment we grant you a non-exclusive, non-transferable, worldwide licence, for personal, non-commercial use, to the extent we hold rights in the portrait: you may print it for yourself, give prints as gifts, use it as a wallpaper or profile picture and share it on non-commercial social media. You may not sell or license the portrait or products bearing it (e.g. mugs or T-shirts for sale), use it in advertising, register it as a trademark, sell it as an NFT, or use it to train AI models. Copyright protection for AI-generated images may be limited in some countries. We will not use your portrait or photos in our shop or marketing without your consent.

10. Your photos and content

You confirm that you own the photos you upload or send or have permission to use them, and that our use of them to create your portrait does not infringe anyone’s rights.
Do not upload photos of people without their consent, photos of children, or unlawful, offensive or infringing content. We may refuse or cancel (with refund) any order that breaks these rules.
You give us a limited licence to process your photos and texts only to create, deliver and support your order, as described in our Privacy Policy.

11. Acceptable use

Do not misuse the service: no automated access or scraping, no attempts to bypass the captcha, verification limits or watermarks, no attempts to access other customers’ orders or files.

12. Liability

We take care to deliver a portrait that looks like your pet, but AI-generated images can contain imperfections; the revision rounds exist to fix them. To the extent permitted by law, our total liability for any order is limited to the price you paid for it, and we are not liable for indirect or consequential losses or for printing results by third parties. Nothing in these Terms limits liability that cannot be limited by law, including liability for wilful misconduct or gross negligence, death or personal injury caused by negligence, fraud, or your mandatory rights as a consumer.

13. Governing law and disputes

These Terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory provisions of the law of the country where you habitually reside, and you may bring proceedings in the courts of that country. Please contact us first through Etsy Messages or at support@pigmentpaw.com – most issues are solved quickly.

14. Changes and contact

1. Chi vende: il servizio PigmentPaw (pigmentpaw.com) è gestito da Nicolò Luppi, persona fisica con sede in Italia, support@pigmentpaw.com. Al momento vendiamo tramite il nostro negozio Etsy PigmentPawArt (etsy.com/shop/PigmentPawArt): gli acquisti sono regolati dalle condizioni e dalle policy di Etsy e, in quanto compatibili, da queste condizioni (prodotto, foto, anteprime, revisioni, licenza). Gli acquisti diretti su pigmentpaw.com al momento non sono disponibili; se li attiveremo, pubblicheremo prima le relative condizioni.

2. Prodotto: ritratto digitale del tuo animale realizzato dalle tue foto; nessun bene fisico viene spedito. File ad alta risoluzione (JPG; PNG solo se indicato, es. decorazioni; e, se indicato, sfondo per telefono, ritaglio Instagram o PDF); i bundle sono consegnati in un unico file zip. I colori possono variare leggermente tra schermi e stampanti.

3. Uso dell'AI: i ritratti sono creati con strumenti di intelligenza artificiale, eseguiti tramite fal.ai, con prompt e direzione artistica nostri: anteprime con Nano Banana 2.1 di Google; file finali con GPT Image 2.5 di OpenAI e l'upscaler SeedVR2 per gli stili Reale / Rinascimento e In memoria (fiori e arcobaleno) (Nano Banana Pro di Google se questa procedura non è disponibile), con Nano Banana 2.1 di Google per gli stili cartoon 3D e con Nano Banana Pro di Google per tutti gli altri stili. Controlliamo noi la somiglianza di ogni ritratto prima della consegna. Dettagli nell'informativa privacy. Nessun pittore li dipinge a mano. Uno stile simile può essere prodotto anche per altri clienti; le immagini possono contenere marcature digitali di provenienza invisibili.

4. Foto e anteprime gratuite: ogni ritratto usa da 1 a 5 foto di riferimento (per il ritratto con due animali fino a 5 foto per animale). Dopo aver caricato le foto per il tuo ordine Etsy vedi anteprime a bassa risoluzione con filigrana e scegli la tua preferita; le anteprime non possono essere usate né modificate per togliere la filigrana.

5. Ordine e consegna: la conferma d'ordine Etsy e il nostro PDF «How it works» riportano la pagina di caricamento pigmentpaw.com/etsy-upload: inserisci il numero dell'ordine Etsy e il nome dell'acquirente esattamente come sull'ordine Etsy (email facoltativa) e verifichiamo l'ordine in tempo reale presso Etsy (pagato, non rimborsato né annullato, articolo acquistato); dopo 5 tentativi falliti in un'ora la verifica si sospende per 1 ora; se l'ordine contiene più ritratti hai un caricamento per ciascuno; poi carichi le foto (da 1 a 5, fino a 5 per animale con due animali; consigliati almeno 1000 px sul lato corto). Il caricamento è possibile per 14 giorni dall'acquisto e fino a 5 caricamenti per ritratto (primo invio + revisioni), a seconda di quale evento si verifica prima, ed è bloccato in caso di rimborso totale o annullamento. Se entro 24 ore dall'ordine non hai caricato le foto, ti scriviamo un promemoria in Etsy Messages. In alternativa puoi inviare foto o un link a un album Google Foto/iCloud in Etsy Messages e le carichiamo noi. Anteprima gratuita entro 24 ore dalla ricezione di foto idonee; file finali entro 24 ore dalla scelta dello stile, come link di download nell'aggiornamento dell'ordine Etsy (Etsy te lo invia anche per email). Il sistema di Etsy non può allegare un file diverso a ogni ordine: il file digitale dell'annuncio è il PDF «How it works», uguale per tutti. Al momento non inviamo email. File e link scadono 30 giorni dopo la consegna, poi vengono cancellati (l'aggiornamento dell'ordine Etsy indica data e ora esatte di scadenza in UTC): scarica e conserva una copia. Se non vedi l'aggiornamento dell'ordine controlla Etsy Messages e lo spam e scrivici tramite Etsy Messages.

6. Somiglianza e revisioni: 2 giri di revisione gratuiti, da richiedere entro 14 giorni dalla consegna (correzioni di somiglianza e piccole modifiche nello stesso stile). Non contano come revisione la scelta di un'altra anteprima già inviata e la correzione di nostri errori; non sono incluse le modifiche di stile dopo la consegna finale o il cambio/aggiunta di animali (nuovo ordine). Dopo che l'ordine è stato spedito, i file rivisti arrivano come link di download in un messaggio Etsy da parte nostra. Se il periodo di caricamento (14 giorni dall'acquisto o 5 caricamenti) è terminato, invia note o nuove foto in Etsy Messages: le carichiamo noi. Se dopo le revisioni il ritratto non somiglia ancora al tuo animale, lo rifacciamo o ti rimborsiamo, a tua scelta. Richieste tramite Etsy Messages.

7. Rimborsi: rimborso totale se la somiglianza non è raggiunta dopo le revisioni e preferisci il rimborso al rifacimento, se non riusciamo a produrre un ritratto accettabile, se annulli prima che iniziamo il lavoro o in caso di doppio addebito; rimborsi parziali quando è interessata solo una parte dell'ordine o se indicato nell'annuncio. Salvi i diritti di legge, nessun rimborso per semplice ripensamento dopo la scelta dell'anteprima e la consegna dei file. I rimborsi passano da Etsy, sul metodo di pagamento originale. Con il rimborso totale o l'annullamento link revocati, file cancellati e licenza cessata: il nostro sistema lo fa appena rileva il rimborso o l'annullamento su Etsy. Un rimborso parziale non comporta la cancellazione dei file né la fine della licenza: lo verifichiamo manualmente.

8. Diritto di recesso: i consumatori UE e del Regno Unito hanno di norma 14 giorni per recedere dagli acquisti a distanza. Il diritto di recesso è escluso per i beni o contenuti digitali confezionati su misura o chiaramente personalizzati (art. 59, comma 1, lett. c, D.Lgs. 206/2005; art. 16, lett. c, Direttiva 2011/83/UE) e, per gli altri contenuti digitali, cessa quando la fornitura è iniziata con il tuo previo consenso espresso e la tua presa d'atto. Ogni ritratto è realizzato su misura dalle tue foto e scelte. Puoi comunque annullare gratuitamente prima che iniziamo il lavoro (punto 7). Restano sempre salve la garanzia legale di conformità e la nostra garanzia di soddisfazione (punto 6). Per gli ordini su Etsy si applicano anche il checkout e le policy di Etsy.

9. Licenza: a pagamento completato ricevi una licenza non esclusiva, non trasferibile e mondiale per uso personale e non commerciale, nei limiti dei diritti di cui disponiamo: stampa per te, regali, sfondi, foto profilo e social non commerciali. Vietati rivendita, prodotti in vendita con il ritratto, pubblicità, marchi, NFT e addestramento di modelli AI. La tutela d'autore delle immagini generate con AI può essere limitata in alcuni Paesi. Non usiamo il tuo ritratto o le tue foto per il marketing senza il tuo consenso.

10. Le tue foto: dichiari di essere titolare delle foto o autorizzato a usarle e che il loro uso non viola diritti di terzi. Vietato caricare foto di persone senza consenso, di bambini o contenuti illeciti/offensivi; possiamo rifiutare o annullare (con rimborso) l'ordine. Ci concedi una licenza limitata a trattare foto e testi solo per realizzare, consegnare e assistere il tuo ordine (vedi Privacy).

11. Uso corretto: vietati accessi automatizzati, aggiramento di captcha, limiti di verifica o filigrane, tentativi di accedere agli ordini o ai file di altri clienti.

12. Responsabilità: nei limiti consentiti dalla legge, la nostra responsabilità per ciascun ordine è limitata al prezzo pagato e non rispondiamo di danni indiretti o dei risultati di stampa di terzi. Nulla limita la responsabilità per dolo o colpa grave (art. 1229 c.c.), per danni alla persona, frode o i diritti inderogabili del consumatore.

13. Legge applicabile: legge italiana, fatte salve le norme inderogabili a tutela del consumatore del Paese di residenza abituale e il foro del consumatore. Contattaci prima tramite Etsy Messages o a support@pigmentpaw.com.
